Thank you for choosing Bysunset.
Bysunset is a platform that allows users to access and use its services, including the Bysunset Platform. The platform's terms of use are intended to make users aware of their legal rights and responsibilities regarding their access to and use of the platform. Bysunset's use and access of the platform are governed by these Terms and the Privacy Policy. Users must accept these Terms and acknowledge that they constitute an agreement between them and Bysunset.
The terms "visitor(s), user(s), you" (you), "your" (customer(s)") refer to the person visiting, accessing, viewing, browsing through, or using the Bysunset Platform at any point in time. If you need any clarifications regarding the Terms, please write to Privacy@bysunset.in.
The Bysunset Platform is designed for end-consumers desirous of purchasing products/availing services for fashion, accessories, footwear, and makeup. It is not suitable for retailers, institutions, wholesalers, or other business-to-business users. Bysunset uses algorithms and pre-determined criteria-based technology to determine compliance with eligibility criteria, and usage may be restricted or blocked due to overlap.
Users must register and log in for placing orders on the Bysunset Platform and keep their account and registration details current and correct for all communications related to their purchases. By agreeing to the Terms, users agree to receive promotional, transactional, or newsletters from Bysunset and its group companies/affiliates. They can opt out from such communications and/or newsletters by using the opt out options available in such communications.
By registering their mobile number with Bysunset, users provide their consent to be contacted by the platform or through a third party service provider via phone calls, SMS notifications, mobile applications, or any other electronic mode of communication in case of any order, shipment, delivery, customer support-related updates, or other correspondence as may be required in due course of provision of the Services.
Limited Licence & Access
In conclusion, Bysunset is a platform that allows users to access and use its services, including the Bysunset Platform. Users must be aware of their legal rights and responsibilities when using the platform and are responsible for their own actions and interactions.
Bysunset grants a personal, limited, non-exclusive, non-transferable, and revocable license to access the Bysunset Platform and avail the Services for personal use only. This limited license does not permit any resale or commercial use of the Bysunset Platform or its contents, collection, use, derivative use, downloading or copying of information for the benefit of another third party, or using data mining, robots, or similar data gathering and extraction tools.
You agree not to use, host, display, upload, modify, publish, transmit, update, or share any information, content, comments, language, or document that violates these Terms. Prohibited content and actions include sharing or posting content you don't have rights to, sharing harmful, abusive, illegal, obscene, offensive, discriminatory, defamatory, or promotes crime, impersonating others or disguising the origin of your content, infringing intellectual property or violating laws, spreading viruses or malicious software, threats to national security, public order, or international relations, providing false, misleading, or deceptive information, spamming, running scams, or commercial promotions without permission, interfering with the platform's functionality, security, or other users' data, hacking, reverse engineering, or breaching confidentiality or contracts, collecting or misusing others' personal data, posting automated/bot-generated content, or attempting any of the above actions.
Bysunset has no obligation to monitor your access to or use of the Services for violations of the Terms or to review or edit any content. Any and all liability arising out of or relating to violation of these Terms is your sole and absolute responsibility, and not of Bysunset.
Bysunset Platform or any portion of the Platform may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express prior written consent of Bysunset. You must not attempt to gain unauthorized access to any portion or feature of the Bysunset Platform, or any other systems or networks connected to the Bysunset Platform, by hacking, password mining, or any other illegitimate means.
In case of a charitable campaign, Bysunset is not involved in the collection or utilization of funds collected pursuant to the campaign. Customers are advised to do an independent verification, including accepting the terms and conditions of the relevant charitable organization, before taking any action in this regard.
The Bysunset Platform and Services are provided "as is" and "as available," and users are responsible for their use and interactions with other customers and third-party providers. Bysunset, its group companies, affiliates, and their respective directors,
employees, officers, agents, and representatives disclaim all warranties, express or implied, in connection with the Bysunset Platform and the Services and your use of them. Bysunset makes no representation or warranties regarding the accuracy or completeness of content on the Bysunset Platform or the Services, and assumes no responsibility for any errors, mistakes, inaccuracies, personal injury, property damage, unauthorized access to or use of Bysunset servers and personal information stored therein, interruption or cessation of transmission to or from the Bysunset Platform, bugs, viruses, trojan horses, or the like which may be transmitted to or through the Bysunset Platform or through the actions of any third party.
You acknowledge and undertake that you are using your best and prudent judgement before entering into any transactions. Bysunset does not make any representation or warranties in respect of the products/services (including digital goods) available on the Bysunset Platform nor does Bysunset implicitly or explicitly support or endorse the sale or purchase of such products/services on the Bysunset Platform, including relating to availability, usability, redemption or acceptance of such products on any other platform. Bysunset accepts no liability for any error, inaccuracy, or omission of third parties or for information/inputs received from third parties and provided to you through the Bysunset Platform or otherwise.
Delivery partners facilitate delivery of orders placed on the Bysunset Platform through independent contractors. There exists no principal-to-principal relation between Bysunset and the delivery partner, and as such, Bysunset cannot be held liable for the act(s)/omission(s) of the delivery partner. Users are expected to respect the dignity and diversity of delivery partners and enable provision of a secure and fearless gig/platform work environment for the delivery partners, including prevention and deterrence of harassment (including sexual harassment).
Bysunset reserves the right to withhold access to the Bysunset Platform and limit access at its absolute discretion if users behave in a manner discourteous, disrespectful, abusive, or inappropriate. They are expected to treat all delivery partners with courtesy and respect, and the consequences of any inappropriate action will be to the user's account entirely.
By submitting comments, reviews, feedback, or other content (“Customer Content”) on the Bysunset Platform, users acknowledge that such content is not confidential and may be publicly visible. Users grant Bysunset a perpetual, irrevocable, worldwide, non-exclusive, fully paid, royalty-free, assignable, sub-licensable, and transferable license to use, display, reproduce, modify, adapt, publish, translate, distribute, reformat, incorporate into advertisements or marketing, analyze, promote, commercialize, create derivative works, and otherwise use such content in connection with the operation, improvement, and promotion of the Bysunset Platform and its services.
When uploading photos or images as part of comments, users must ensure they are clear, focused, relevant to the product/service being reviewed and do not contain any Prohibited Conduct or promotional content. Bysunset is entitled to use, reproduce, disclose, adapt, create derivative works from comments, and publish, display, and distribute them without restriction.
Comments are not to violate any terms or third-party rights, including copyright, trademark, privacy, or other personal or proprietary rights. Users are responsible for their own comments and must not contain personal, confidential, secretive, or proprietary information. Comments should not be unlawful, threatening, abusive, obscene, software viruses, political campaigning, commercial solicitation, chain letters, mass mails, or any form of spam.
Bysunset reserves the right to monitor, not publish, and/or remove comments submitted on the platform. Users must not use false email addresses, impersonate individuals, or mislead about the origin of comments. They must indemnify the platform against claims, loss, and liabilities resulting from comments.
Comments are not copied from or based on any other content, work, or website, and are not submitted via automated processes. Users must ensure their comments are truthful, accurate, and do not violate any applicable laws.
In addition to the above, users must confirm that they were not paid or otherwise remunerated in connection with their commenting or posting, and that they have no financial, competitive, or personal incentive to post a comment that was not a fair expression of their honest opinion.
Customers assume all risks associated with their comments, including reliance on its quality, accuracy, reliability, or disclosure of personally identifiable information. While Bysunset reserves the right to remove comments, it does not control actions or reviews posted by customers and does not guarantee the accuracy, integrity, or quality of any comments or content.
Bysunset reserves the right to remove, block, or disable access to any comments or content that it deems objectionable, in violation of the Terms, or harmful to the Services or its Customers. However, Bysunset does not control actions or Comments posted by users and does not guarantee their accuracy, integrity, or quality. Third party content,
including comments from customers, does not reflect Bysunset's view and is at the sole responsibility of the user.
Bysunset receives multiple reviews or ratings for products/services/sellers, which reflect the opinions of the customer. Each review is the personal opinion of the customer/reviewer only. If a review violates Bysunset's policies, the third party seller may contact the reviewer or post a public response to clear up any misunderstandings. Bysunset may remove the review in its sole discretion if the review is in violation of the Terms or harmful to the Services.
If you share or send feedback regarding Bysunset's existing business, you agree that your feedback does not contain confidential information, Bysunset is under no obligation of confidentiality, and you grant Bysunset a binding, non-exclusive, royalty-free, perpetual, global license to use, develop, publish, distribute, and sublicense the Feedback.
Bysunset does not accept or consider unsolicited ideas, including ideas for new advertising campaigns, promotions, or product enhancements. If you submit unsolicited ideas, you agree that your Submissions will automatically become the property of Bysunset without compensation, and there is no obligation for Bysunset to review the Submissions.
Bysunset reserves all intellectual property rights in all text, programs, products, processes, technology, images, content, and other materials appearing on the Bysunset Platform. Access to or use of the Bysunset Platform does not confer any license or sub-license to any Intellectual Property. All rights, including copyright, are owned by or licensed to Bysunset. Any use of the Bysunset Platform or its contents, including copying or storing them, is prohibited without express prior written consent.
The names, logos, and related product and service names, design marks, and slogans are trademarks/service marks of Bysunset, its group companies/affiliates, brand/its partners, sellers/suppliers/service providers, and all other marks are the property of their respective owners. No trademark or service mark license is granted in connection with the materials contained on the Bysunset Platform.
References on the Bysunset Platform to names, marks, products, or services of third parties or hypertext links to third party sites or information are provided solely as a convenience to users after having express consent from third parties. Bysunset is not responsible for the content of any third party sites and does not make any representations regarding the content or accuracy of material on such sites.
If you believe your intellectual property rights have been violated or used in any manner that results in infringement, please inform Bysunset at grievance.officer@Bysunset.in. We will evaluate the contents of your notice and respond within a reasonable period of time. Reporting inaccurate, false, or misleading information may result in civil and/or criminal liability.
Bysunset respects your privacy and values the trust you place in it. By accessing the Bysunset Platform, you agree to be bound by the terms and conditions of the Privacy Policy and consent to the collection, storage, and use of information relating to you. Bysunset is committed to protecting the confidentiality of its users' personally identifiable information through appropriate physical, electronic, and managerial procedures. However, transmissions made via the internet cannot be fully secure, and Bysunset cannot be held responsible for any disclosure of your information due to errors in transmission or unauthorized acts of third parties.
All calls between users and Bysunset, including those with delivery partners or service providers, may be recorded for internal training and quality purposes. Users expressly agree and permit Bysunset and any third party engaged by them to record these calls
and share them with authorized personnel and relevant third parties. They also consent to sharing any data related to users with its group companies, affiliates, and relevant third parties or governmental/regulatory authorities as required under any law.
Bysunset assumes no responsibility for any communication not authorized by Bysunset regarding offers, promotions, or housefull sales, including fraud or misrepresentation caused by third-party administrators resulting in loss or injury to the user. Bysunset does not run a call center or provide any electronic means of communication, except as specified in these Terms. Users are cautioned against unauthorised persons, fraudsters, and impostors claiming to be calling on Bysunset's behalf.
In case of communication, users can contact info@Bysunset.in or grievance.officer@Bysunset.in. Bysunset does not solicit confidential information or ask users to share sensitive data or information via email or telephone.
Bysunset is a platform that allows customers to place orders and make payments for products and services. Customers are responsible for providing accurate delivery details, including recipient name, address, contact details, and making payments against all orders placed through their account. Bysunset does not have any liability or obligation in this respect, including accepting refunds or order cancellation requests.
If any service or product delivery is delayed or returned from its destination, Bysunset is not liable for the same or responsible for making re-delivery. Any costs incurred by Bysunset in this respect shall be borne by the customer.
While Bysunset makes best efforts to ensure that products/services are delivered within the period reflected at the time of placing the order, it does not make any representation, guarantee, or warranty in relation to the delivery time. The estimated delivery time may be changed without notice and there could be delays for reasons beyond the reasonable control of Bysunset, such as availability of third party delivery service providers, demand, traffic and weather conditions, a force majeure event, the location provided by the customer(s), the customer(s) being unresponsive on call, user’s building norms, delivery partner(s) facing any on-ground challenges, etc.
Customers are responsible for the products when they direct the delivery partner to leave the product at their doorstep or handover the product to another person. In such cases, customers cannot claim any amount/refund from Bysunset in case of any loss/damage to/deficiency in any products/Service. They expressly disclaim Bysunset from all liabilities which may arise by virtue of the order being left unattended for a period of time.
In case of cash on delivery orders placed through the customer's account, it is the customer's sole responsibility and obligation to make the cash amount payment and ensure that the same is accurate. Bysunset is not liable for any discrepancy in this respect.
Customers are required to use the products/services for lawful purposes only and comply with all applicable laws and regulations while using/accessing and transacting on the Bysunset Platform. They must provide authentic and true information when requested, and Bysunset reserves the right to confirm and validate the information and other details provided by them at any point of time.
Transactions through the Bysunset Platform may be subject to delivery charges, handling charges, convenience charges, platform charges, small cart charges, high demand surge charges, rain surge charge, print charges, gift charges, or other fees/charges levied from time to time. Bysunset may also offer customers credits, discounts, promo codes, vouchers, or other forms of cashback that it may decide at its discretion.
Customers acknowledge that they have checked and reviewed the product/service description carefully and are bound by the conditions of sale/supply without exception.
Bysunset is committed to providing the best possible experience and information to its customers. Customers acknowledge and agree that the form and nature of the Services may require changes, and Bysunset reserves the right to suspend/cancel or discontinue any or all products or services at any time without notice. The software or software application store may include functionality to automatically check for updates or upgrades to the software, and customers may be required to install certain upgrades or updates to continue accessing or using the Services.
In an effort to continuously improve the Bysunset Platform and Services, research and experiments are conducted on various aspects of the Services and offerings, including apps, websites, user interface, and promotional campaigns. This aims to make the Bysunset Platform better, more convenient, easy to use, improve customer experience, enhance safety and security, and develop new services and features.
Taxes on your order are issued as mandated per applicable law and common business practices. Your order may have components and corresponding documents, such as tax invoices for sale of goods, tax invoices for supply of services, and tax invoices for third-party offerings. These documents can be seen on the order summary page once the goods have been delivered to you.
You acknowledge and agree that entitlement to GST benefits with respect to eligible products/services purchased through the Bysunset Platform shall be subject to the GST terms and conditions (in addition to these Terms) and submission of a valid GST number by you. Not all products/services are eligible for a GST invoice, and these terms and conditions are deemed incorporated into these Terms by reference and subject to change from time to time.
Bysunset is committed to providing a secure and efficient platform for customers to make purchases and transactions. However, it is important to note that any cancellation or attempted cancellation of an order, or any cancellation due to reasons not attributable to Bysunset, constitutes a breach of the Terms. Any such request must be accepted by Bysunset and will result in a refund against the relevant product/order, which may be in the form of promotional codes/coupons. These refunds will be available for use against a subsequent invoice for transactions on the Bysunset Platform, in accordance with the specified terms.
Bysunset aims to ensure that the availability status, specifications, and prices of all products/services offered for sale are true and correct. However, technical issues, typographical errors, or incorrect product/service information provided by Third-Party Sellers may cause errors or inaccuracies in these specifications. In such cases, Bysunset reserves the right to cancel the order and initiate a refund against the relevant product/order in the form of credit/ cashback/ coupon/ promotional codes for the value of the relevant product/order.
Returns and refunds are non-returnable, non-replaceable, non-exchangeable, and non-refundable, except for products that are damaged, defective, expired at the time of delivery or incorrectly delivered. For digital goods, no return/refund shall apply, and users are required to connect with the relevant issuer/seller in case of any issues including validity, usage restrictions, and redemption related issues. All refunds for permitted returns and cancellations will be processed within 7 working days from the date of return/cancellation approval of the product subject to satisfactory checks.
For payments made through electronic means such as debit card, credit card, net banking, UPI, etc., refunds shall be processed in the same manner as they are received or provided in the form of credit/ cashback/ coupon/ promotional code. Refund amounts in the form of credits will reflect in the user's account based on respective banks policies. Refunds for products purchased on cash on delivery basis shall be refunded by way of promotional codes or through electronic means. Users can opt-in for a promotional code refund for online payments as well.
Bysunset Cashback refers to the grant of credit for the amount of eligible cashback, which shall be added to and reflected on the user's account. Cashback will be either transactional or promotional, and a user will be entitled to Cashback only as specified by Bysunset. No Cashback shall be available for orders that are not returned in its original condition, are spoiled, damaged, worn, and/or are not the one delivered. and in such cases, any Cashback offered may be recovered by Bysunset without notice to the user.
Bysunset reserves the right to withdraw, suspend, amend, or cancel the Cashback offers, and the terms applicable thereto at any time, without liability or prejudice to any of its other rights. Transactional and promotional Cashback will reflect in a user's Bysunset account within approximately 24-48 hours, but some coupons may take 7 working days from the delivery of the order for the cashback to reflect. The validity period of these offers is 90 days and 60 days for transactional and promotional Cashback respectively from the date of credit, unless a different time period is specified by Bysunset.
Bysunset does not endorse or support the purchase of products or undertaking of transactions subject to Cashback. Cashback and discount codes may not be applicable on certain products/services, as determined by Bysunset, from time to time.
The Bysunset Platform offers promotional campaigns that are subject to additional terms and conditions. Eligible customers who meet the eligibility criteria set forth by Bysunset or its collaboration partners for the specific promotional campaign are referred to as "Eligible Customer(s)." These promotions run for a duration decided by Bysunset at its sole discretion and may be prematurely revoked without prior notice. If the Promo Offer is based on a minimum order value, it will stand cancelled if the products are returned by the Eligible Customer or for which refund is given by Bysunset or if the order for such products is cancelled by the Eligible Customer.
By participating in the Promo Offer, Eligible Customers agree that Bysunset Parties are not liable for the services provided by third parties upon availing/redeeming the offer/voucher/prize. They also consent to Bysunset sharing their contact details with authorized third parties for making the Promo Offer available to them, and this information will be governed by the third party's privacy policy/ies.
The Promo Offer cannot be sold, transferred, encashed, or exchanged for any other products nor clubbed with any other Promo Offer. Bysunset accepts no liability for any errors or omissions of any third party in relation to the Promo Offer. The voucher/prize/benefit details will be sent to the Eligible Customer via email/message/WhatsApp/in-app.
By participating in the Promo Offer, Eligible Customers are deemed to have accepted these terms along with specific promotional activity terms and conditions made available to them. They expressly agree that Bysunset Parties will not be liable or responsible for any loss or damage that the Eligible Customer may suffer, directly or indirectly, in connection with this Promo Offer, including theft, loss, or misuse of the Promo Offer or the Information.
Payment facilities on the Bysunset Platform are compulsory in Indian Rupees only. Payment methods may include credit card or debit card, net banking, UPI, cash on delivery, or any other RBI approved payment mode. Bysunset may use certain third
party vendors and service providers to process payments and manage payment card information. Customers must represent, warrant, and covenant that they are legally entitled and authorized to provide payment details and make payments using such payment details.
The payment facility provided by Bysunset is neither a banking nor a financial service but merely a facilitator providing an electronic, automated online electronic payment system. In respect to certain payment methods, the respective issuer may charge additional fees for processing your payment transaction.
In summary, Bysunset is a platform that allows users to manage their order history and provide real-time resolution for any order-related issues. Users can contact the Grievance Officer at grievance.officer@Bysunset.in, as per the Information Technology Act, 2000, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020.
Bysunset is committed to indemnifying, defending, and holding harmless the Bysunset Parties from and against any third party claims, damages, actions, proceedings, demands, losses, liabilities, costs, and expenses arising from or in connection with the user's comment and/or content, unauthorized use of the Bysunset Platform/Services, access to and use of the Services, violation of other party rights, or breach of these Terms. The company retains the exclusive right to settle, compromise, and pay any claims or causes of action brought against the user without their prior consent.
The company is not liable for any claims, damages, or losses to the customer or any other person other than as established by a non-appealable order of a court of competent jurisdiction. The maximum aggregate liability of the Bysunset Parties, if any, shall in no event extend beyond refund of the money charged from the relevant user for purchases made pursuant to the relevant order with respect to which such liability has arisen and been established.
Bysunset is not liable for any indirect, special, consequential, exemplary, punitive, or incidental losses or damages, including on grounds of loss of profit, loss of reputation, or loss of business opportunities. Users must commence any legal action against Bysunset within one year after the alleged harm initially occurs, and failure to commence the action within that period will forever bar any claims or causes of action regarding the same facts or occurrence.
In conclusion, Bysunset is committed to maintaining consumer protection and digital media ethics in its platform. Bysunset's commitment to customer satisfaction and adherence to these terms and regulations ensures that its users have a secure and efficient experience on the platform.
Bysunset, a platform that offers services, may terminate or refuse your registration, use of the platform, or restrict your access to the services without notice or cause. This can be done by evaluating usage patterns or if Bysunset has reason to believe that you do not conform to the eligibility criteria or may commit a breach of these Terms. If you use
the services in violation of these Terms, Bysunset may retain all data collected from your use of the services.
You can delete your account at any time by using the option available on the Bysunset Platform/App and ceasing further use of the platform. Bysunset's rights to any Comments, indemnification rights, and provisions relating to Governing Law and Jurisdiction shall survive any termination of these Terms. Any such termination will not affect your obligation to pay for products or services already ordered or availed from the Bysunset Platform or affect any liability that may have arisen relating to events preceding the date of termination.
Governing Law and Jurisdiction ensure that these Terms are governed by and construed in accordance with the laws of India, without giving effect to the principles of conflict of laws thereunder. Courts at Surat have exclusive jurisdiction over any proceedings arising in respect of these Terms (including Privacy Policy). Miscellaneous provisions in these Terms are included for reference only and shall not be used to interpret any provisions of these Terms.
The terms and subject headings in these Terms are included for reference only and shall not be used to interpret any provisions of these Terms. The entire agreement and waiver between you and Bysunset concerning the Services shall be governed by and construed in accordance with the laws of India, without giving effect to the principles of conflict of laws thereunder.
In the interest of improving customer/user experience or other reasons as deemed fit, Bysunset/Third Party Sellers may collaborate with third parties (including brands, product manufacturers, platform sellers, vendors, and service providers) to provide certain services. These services are solely provided by such third parties, as per their terms and conditions and privacy policy. Bysunset has no control over the quality, fulfillment, and completion of these services, including customer care support,
grievance, etc., as these are fulfilled by third parties. Bysunset does not provide any guarantee or warranty and makes no representations regarding these services, including reliability, quality, merchantability, fitness for any particular purpose or suitability thereof.
By opting in for such services or placing an order for the product that includes such services in the package, you explicitly give your consent to share your personal information with the third party service provider to provide the services. Bysunset is not liable for any act or omission of the third party service provider, and Bysunset will not mediate any disputes or differences between you and the third parties in relation to this.
